1. Acceptance of Terms

By visiting our website, submitting an enquiry, or starting a project with Brand360s, you agree to these Terms and our Privacy Policy. If you disagree with any part, you may discontinue use of the website or decline service engagement.

You confirm that you are:

• Above 18 years of age, or accessing the site with parental/business consent
• Using the website and services lawfully and responsibly

2. Scope of Services

Brand360s provides professional services including:

• Branding, logo design & brand identity systems
• Graphic design, social media creatives, posters & marketing assets
• Website UI/UX design, development & redesign
• Website technical fixes, updates & maintenance
• SEO, Local SEO & Google Business Profile optimization
• Digital marketing strategy, ads support & performance marketing
• Social media management, content writing, reels, and video editing
• Corporate & personal branding, PR support
• Photography & videography for business and personal branding

We reserve the right to update service descriptions at any time.

3. Project Engagement & Deliverables

Services begin only after:

• A written proposal or quotation is accepted
• Payments & deposits (where applicable) are made
• Required inputs, content, brand materials, logins or approvals are provided

Brand360s shall not be held responsible for project delays caused by:

• Delayed client approvals
• Incomplete content
• Missing logins or integrations
• Scope changes
• Unresponsive communication

Client delay beyond 14 days may result in project suspension, and reactivation may require an additional fee.

4. Payments, Billing & Refund Policy (Strict)

All payments are 100% non-refundable, including:

• Branding
• Design work
• Websites
• SEO
• Digital marketing
• Strategy
• PR
• Photography/videography
• Content creation

This clause protects Brand 360s from misuse of work, concepts, or intellectual property.

Payment obligations:

• Payments must be made as per invoice terms
• Late payments may pause the project
• Final files are delivered only after full payment

Additional charges apply for:

• Extra revisions (beyond the agreed number)
• Scope expansion
• Urgent delivery requests
• Third-party plugins, hosting, domain renewal, API fees

5. Intellectual Property Rights

5.1 Ownership of Brand 360s Work

Unless explicitly transferred under a paid license:

All raw files, design concepts, drafts, sketches, source files, strategy documents, wireframes, UI systems, content plans and internal frameworks are owned by Brand 360s.

The client receives the final approved deliverable only, in the agreed format (PNG, JPG, PDF, MP4, Website Access, etc.).

5.2 Portfolio Rights

Brand 360s reserves the unrestricted right to:

• Showcase projects in its portfolio
• Display designs on website & social media
• Use screenshots for marketing, case studies, reels

Clients requiring confidentiality must request an NDA before the project starts.

6. Revision Policy & Scope Changes

• Projects include a specific number of revisions as per proposal
• Additional revisions are billable
• Major changes after approval → considered new scope

Brand360s is not responsible for delays caused by revision cycles.

7. Third-Party Tools, Platforms & Dependencies

Brand360s frequently uses tools like:

• WordPress / Shopify / Webflow
• Hosting companies
• Plugins & APIs
• Google, Meta, WhatsApp, Zoom
• AI tools or automation tools

We are not liable for:

• Outages
• Bugs
• Downtime
• Third-party policy changes
• Platform restrictions

We will support resolutions wherever reasonably possible.

8. No Performance Guarantees (SEO, Ads, Social Media)

Due to algorithmic and external factors, Brand360s does NOT guarantee:

• Number of leads
• Sales
• Instagram/Facebook growth
• SEO ranking position
• Guaranteed Google Maps placement
• Virality of posts or reels
• Media placement outcomes

We guarantee effort, strategy, optimization, and industry-standard execution, not business outcomes.

9. Confidentiality

Both parties agree to protect confidential information shared during the engagement, including strategy, business details, logins, and personal information.

Brand360s follows strong security measures but is not responsible for breaches caused by:

• Third-party hosting
• Client-side device vulnerabilities
• Password sharing

10. Termination of Services

Either party may terminate the engagement with written notice.

Upon termination:

• All completed work remains with Brand360s unless paid in full
• No refunds are applicable
• Outstanding dues must be settled immediately

11. Limitation of Liability

Brand360s is not liable for:

• Loss of revenue
• Loss of opportunities
• Loss due to ranking changes
• Client-side technical errors
• Business outcomes from strategies supplied

Our liability is limited to the amount paid for the service in question.

12. Prohibited Uses

You agree NOT to:

• Copy our frameworks, processes, or internal systems
• Reverse-engineer our designs or code
• Use the website for fraudulent activities
• Harm the Brand 360s brand or reputation

Violations may lead to legal action.

13. Governing Law

These Terms are governed by the laws of India and any disputes fall under the courts of Chennai, Tamil Nadu.

14. Changes to Terms

We may update these terms at any time. Continued use of the site implies acceptance of the revised Terms.
